Contract:

Please read these terms and conditions carefully as they will tell you what you need to know about the terms on which we will deal with each other.

We recommend that you print a copy of these terms and conditions for any future reference. You can download a PDF version of these terms and conditions HERE.

These terms and conditions will form the basis of the contract between www.internetfireplaces.com (The Company, This Site) and the customer (You) and shall remain in place or prevail over any terms and conditions contained or referred to in order or correspondence or implied by trade, custom practice or course of dealings. These terms and conditions are subject to change at any time without prior notice to you.

Failure by www.internetfireplaces.com to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. Similarly if any of these terms and conditions are found to be unlawful or void or unenforceable then that provision shall be excluded and shall not affect the enforceability of the remaining terms and conditions.

Our terms and conditions do not affect your statutory rights.



General:

Nothing shown on this web site will constitute an offer of goods or services.

The images on this website do not show the actual size of the items and should only be used as a guide. All sizes and measurements are approximate. All manufacturers reserve the right to change their products without notice at any time.

The laws of England and Wales will apply to this contract and any disputes between us will be resolved by the courts of England.

Goods are expressly sold on the understanding that you have checked that the Goods suit the requirements regarding specification and installation.

Goods which have been incorrectly installed may be a serious danger to people and property. You are responsible for the proper installation of the Goods and we cannot accept any liability in respect of any omissions, errors or failures on your part to install the Goods in accordance with the rules in force or with any installation instructions provided by a manufacturer or by www.internetfireplaces.com. Any installation instructions provided by a manufacturer or by www.internetfireplaces.com are provided by way of guidance only to you and the correct method of installation will vary according to the environmental factors present at each installation. You should in no circumstances undertake installation of the Goods unless you, or your agent or employee, are/is suitably qualified and sufficiently expert in such installation to understand how to follow the instructions correctly and install the Goods safely. Gas fires and all associated gas work must be undertaken by a qualified, certified CORGI installer. You indemnify us fully against all costs, claims and expenses arising in connection with any failure by you or your employees, agents or sub-contractors to install the Goods correctly.

Highlighted, polished and chrome finishes are NOT suitable for solid fuel installations as they will permanently discolour. All gas fires for baskets and cast iron inserts are supplied with coals as standard. If you are ordering an insert or basket for a feature only installation and you wish to display it with coals then you will need to add a bag of coals to your order.

In the development of a quarry, inevitable variations will occur in the quarried material colour, shade and veining. Therefore, any samples shown or depicted on this website are representative only and may not exactly match the material supplied. However we guarantee that the material supplied will be to the trade name specified on the order.

Due to the natural characteristics of wood and the issues of accurate colour reproduction via your (the customer's) computer screen/monitor we cannot guarantee an exact colour match to the samples shown on this site. All wood sample colours, whether solid, veneer, painted or stained, shown or depicted on this website are representative only and may not exactly match the material supplied. However we guarantee that the material supplied will be to the trade name specified on the order.

All natural materials such as Wood, Marble, Granite, Stone and Slate cannot be guaranteed for uniformity of appearance, texture and without, grain, veining, knots, fossils, natural cracks or venting flaws. Subsequently all materials are sold subject to their natural characteristics which if necessary will be repaired to an approved stone industry standard before delivery or installation. This does not affect your statutory rights in respect to faulty products.

It is your responsibility to ensure that your chimney or flue is tested to comply with all current legislation regarding it's suitability to accept the appliance or type of fuel specified. It is also your responsibility to ensure that the room where the fireplace is meets any current ventilation requirements for gas or solid fuel fires.

www.internetfireplaces.com has a policy of continuing improvement and may change the specification of the product before delivery to comply with new legislation or regulations or unpredictable variation in the production process. We will contact you via email or telephone regarding any change which significantly affects the quality, appearance and/or usefulness of the product. If the change is not satisfactory we will cancel the order and offer you a full refund with no further liability to either party.

By accessing and using any part of this site, you agree with www.internetfireplaces.com to be bound by these terms and conditions. If you do not accept these terms and conditions you may not use, access or display any of the information made available to you at this site.

Placing An Order:

To order goods through this web site you must be at least 18 years of age.

www.internetfireplaces.com reserves the right to refuse the supply of goods at its discretion.

Making a purchase could not be easier. Just browse our store and add any items that you wish to buy into the shopping basket. After you have finished your selection click on 'Checkout' and complete the required details which we will need to be able to process the order.

We accept Visa, Mastercard, Visa Delta & Maestro.

Before you can submit your order you will be asked to acknowledge that you have read and that you accept our terms and conditions by using a simple tick box.

We will indicate acceptance of your order, and hence a contract between us, when we send you an “Order Received” email. This email will specifically state that the order has been accepted and includes a copy of these terms and conditions.

You should check the confirmation carefully and notify us of any mistakes or changes that need to be made as soon as possible. Changes can be made by calling us on 0845 313 7650 or by emailing us at enquiries@internetfireplaces.com. Major changes will need to be notified in writing via email in addition to any telephone conversation(s).

In the process prior to accepting your order we may find the price for the goods has changed. This could be due to various factors, for example (but not limited to), exchange rates, tax rates, supplier price changes or human error. If the price has changed we will contact you via email or telephone to advise you. If the new price is not satisfactory we will cancel the order and offer you a full refund with no further liability to either party.

www.internetfireplaces.com cannot be held responsible for orders that have been placed by you, the customer, without the required accessories needed to install the goods purchased. We would strongly advise you to ensure you have everything you require before proceeding to purchase any goods from us. Any subsequent orders that arise to this affect will be subject to a minimum carriage charge of £15 (inc. VAT).

In addition to your statutory rights we reserve the right to terminate any contract between us, without penalty, within 7 days from the date that we accept the order.

Delivery:

PLEASE PAY PARTICULAR ATTENTION TO THE FOLLOWING 11 POINTS;

1. Upon delivery of any large, palletised or crated delivery from us you will need to inspect all goods thoroughly BEFORE signing for them. You are entitled to inspect the goods before signing. Check for any signs of damage, including the packaging. If you are unfortunate enough to receive damaged or missing items, you must either REJECT the delivery (if badly damaged) or ensure it is marked 'DAMAGED' on the Carrier's paperwork. You must then inform us, in writing (via e-mail to enquiries@internetfireplaces.com) including photos of the damage, within 72 hours of the delivery otherwise we cannot accept liability. No claims with regard to damaged or broken items can be made after the carrier has left the delivery address unless they have been signed for as damaged.

2. If your order is smaller and delivered by a normal parcel carrier (eg APC, Business Post, UPS etc) then you will need to inspect the packaging for any signs of damage. With a normal parcel carrier you cannot inspect the contents before signing. Boxes leave us in good, if not pristine, condition. If in any doubt as to the condition of the contents you must ensure the Carrier's paperwork is marked as 'DAMAGED'. Once you have accepted the delivery you can then check the contents. If you are unfortunate enough to receive damaged or missing items you must then inform us, in writing (via e-mail to enquiries@internetfireplaces.com) including photos of any damage, within 72 hours of the delivery otherwise we cannot accept liability. No claims with regard to damaged or broken items can be made more than 24 hours after the parcel carrier has left the delivery address unless they have been signed for as damaged.

3. All large, palletised or crated deliveries are booked in via phone call directly with you, the customer. This includes a specific date and an approximate time slot. This is to allow you to be suitably prepared for the delivery and gives you time to arrange for additional help should you need it (see point 5 below). The only exception to this is if we are delivering to a business address in which case a book-in is unlikely.

4. If your order has several components, they will most likely be polythene shrink wrapped on a pallet or crate. You will therefore need to remove the wrapping to check there is no damage. You are entitled to do this.

5. The majority of fireplace components are large and/or heavy and will require two able-bodied people to lift them.

6. The Carrier is contracted to deliver to your home address only. He is not responsible (nor is he insured) for carrying them into your property. Some drivers may offer to help, please be aware that should they damage the goods or your property they are not covered by insurance. The Carrier may transport your goods to your door by a hand pulled pallet truck. Please be aware that these trucks will not operate along uneven or gravel driveways or into your house or flat.

7. NEVER sign for items as unexamined or unchecked. You are entitled to check the goods. If for any reason the carrier refuses to let you inspect the goods you should REJECT the delivery and contact us immediately.

8. Only sign for your delivery if the items are in good condition and you are satisfied that they are not damaged. If in any doubt REJECT the delivery and contact us immediately.

9. Keep your pallet and packaging in the unlikely event that you may have to return any item found to be damaged or incorrect.

10. Bearing in mind the pre-arranged, awkward and heavy nature of our deliveries, their high value and that they often include vulnerable materials such as glass and stone, internetfireplaces.com considers 72 hours to be an adequate and reasonable length of time in which to check the goods.

11. We use a pallet network carrier to deliver the majority of our large palletised and crated deliveries. The network we use are genuinely and generally very professional and helpful. Regrettably there will always be the occasional exception to the rule - a driver who might be bad-tempered or in an unusual hurry. In our experience any driver who pressures for a signature or is in a hurry to go generally has something to hide! You are entitled to inspect the goods BEFORE SIGNING for them. Instructions to this effect are attached to both the goods themselves and to the manifest that you will be asked to sign. NEVER sign for goods as unexamined or unchecked. If in any doubt about the delivery or the delivery driver REJECT the delivery and contact us immediately.

All goods remain the property of www.internetfireplaces.com until such time as the goods are paid for in full.

All deliveries are subject to cleared payment in full.

On delivery all goods must be signed for by an adult aged 18 years or over.

Once your order has been processed www.internetfireplaces.com will only deliver to the delivery address specified on the order.

www.internetfireplaces.com will only deliver to addresses that fall within the mainland UK.

www.internetfireplaces.com reserves the right to refuse delivery to any particular postcodes at it's discretion.

Delivery times are estimated in good faith and depend on our being able to obtain necessary items from third party suppliers. We will make every reasonable effort to meet the times specified but we cannot accept responsibility for delays outside of our control, for example (but not limited to), strikes or accidents. All delivery dates are approximate only and we shall not be liable for any loss, costs, damages, charges or expenses incurred by you in the delayed delivery of the goods to you however caused.

The majority of goods will be delivered within 2-4 weeks of the order being accepted by www.internetfireplaces.com. If an order is likely to take longer than 4 weeks you will receive an email or a telephone call to advise you of the anticipated delivery date. If this is not satisfactory we will cancel the order and offer you a full refund.

Delivery is FREE on all orders over £250 inc. VAT and that fall within the criteria set out within these terms and conditions. www.internetfireplaces.com may elect, at it's discretion, to charge the customer for deliveries that fall outside of the normal criteria set out within these terms and conditions. We will contact you via email or telephone to advise you of these charges should they apply. If this is not satisfactory we will cancel the order and offer you a full refund.

You should inspect Goods on delivery to ensure that they are correct and that they are free from damage and other defects. We cannot accept liability for damage to Goods if you have signed the carrier's delivery note accepting that the Goods have been checked, complete and received "in good condition". Therefore, check the goods thoroughly before accepting them and refuse any items with visible damage. Never sign for items as unexamined or unchecked.

Prices:

All prices include VAT at 17.5%. All prices are in GBP Sterling.

www.internetfireplaces.com reserves the right to make amendments to any advertised product at any time.

www.internetfireplaces.com reserves the right to add or remove any product at any time.

www.internetfireplaces.com reserves the right to withdraw or change any discounts offered at any time.

This will be without any liability to you the customer.

Credit Card Security:

www.internetfireplaces.com accepts payment via any of the following cards; Visa, Mastercard, Visa Delta & Maestro.

www.internetfireplaces.com uses Protx as it's Payment Service Provider.

All transaction information passed between www.internetfireplaces.com and the Protx VSP System is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to our servers from Protx are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing we pass to the Protx servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Once on Protx's systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data Protx holds is extremely secure and Protx are regularly audited by the banks and banking authorities to ensure it remains so.

No individuals within www.internetfireplaces.com or Protx are able to decrypt transaction information or cardholder data. Protx's systems only allow access to their most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even from our own employees because our systems never display the full card numbers, even on administration level screens.



Liability:

All goods are supplied as soon as possible and in good faith.

We will not be liable for any losses that you suffer as a result of any breach of our agreement. In particular, as the goods and services are provided to you as a consumer, we cannot accept any loss of profit, loss of contracts and loss of revenue or other business loss or depletion of goodwill that you may incur as a result of any breach of our agreement. Any injury, damage or loss arising directly from the negligence of the www.internetfireplaces.com or any of its agents will be limited to a refund of the value of the goods purchased.

Goods are subject to availability. If the goods become unavailable due to delays on the manufacturers part or if we fail to supply the goods for this reason or any other reason beyond our control, we will refund all monies paid in full for the goods, although we will not accept any responsibility for compensating you for any losses you may suffer in connection to this delay.

Most of the products shown on our web site are of a technical nature. Due to the sheer size of the range we offer it is not possible to provide exhaustive specification for the products on the site and it is not possible to keep all of the information accurate at all times. All drawings, descriptions and specifications are for information only, i.e. for the purpose of providing you with approximate information about the goods before you make a purchase. We provide links, where available, to most of the manufacturers web sites where you will find more detailed information on the products. Alternatively you can contact us on 0845 313 7650 to confirm or clarify details prior to placing an order.

If you purchase goods from us, based on information on our site, which are of an unsuitable specification which was not apparent at the time of ordering, then we will accept the return of the goods, in good condition, as per the procedure(s) specified under the "Returns And Cancellations" section of these terms and conditions.

We do not exclude or restrict our liability for death or personal injury resulting from our negligence or that of our agents. If you suffer any other loss or damage, our liability to you will be limited to the value of this Contract. We will not in any event be liable for (a) any economic loss or damage (including loss of profit, revenue, business, contract, goodwill, or other financial loss); or (b) any indirect or consequential loss or damage which is not reasonably foreseeable as likely to occur in the ordinary course of events.

Privacy Policy:

www.internetfireplaces.com do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses (if the address book is used) and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process.

We will endeavour to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering.

Returns And Cancellations:

As a consumer, under the distance selling regulations, you have the right to cancel this agreement within 7 days for a full refund excluding the cost of returning the goods. Returning the goods in this context is the customer's responsibility.

Goods made to the customer's own specification cannot be cancelled under the distance selling regulations. This includes, but is not limited to, ALL made to measure goods, goods where a specific colour or finish is specified or any other similar bespoke attribute.

The customer is responsible for insuring that the goods are kept in good condition, unused, in re-saleable condition and returned complete with all parts in their original packaging. Any damage or missing parts will be subsequently deducted from any refund owed.

To cancel an order you must provide us with notice in writing, via email, fax or post, within the 7 days. Notice via telephone is not acceptable. We will respond with a Returns Authorisation Number (RAN) which you will need to mark clearly on the outside of the packaging.

You, the customer, will be responsible for the action and costs of returning the goods to us, unless the item was sent to you in error or the item is faulty in which case www.internetfireplaces.com will arrange collection at our cost.

The 7 day period starts the day after you receive the goods.

The goods do not have to be returned within the 7 day period, they should however be returned within 14 days from the day after you receive the goods.

For your protection, we insist that you use a recorded delivery service with adequate insurance.

No return will be accepted without an Returns Authorisation Number (RAN) clearly marked on the outside of the packaging, irrespective of whether the goods were supplied in error, are faulty or are being returned as a cancelled order under the distance selling regulations. Subsequent costs of a rejected delivery by www.internetfireplaces.com due to the absence of a Returns Authorisation Number (RAN) are the sole responsibility of the sender, i.e. the customer. If necessary telephone 0845 313 7650 prior to returning anything.

If the goods are not returned within 30 days from the day after you receive the goods we will charge you, the customer, the cost(s) involved with us attending your premises to collect the goods and we will deduct this from any refund owed.

Our terms and conditions do not affect your statutory rights.



Faulty Goods:

All products offered on this site come with a minimum of a 1 year manufacturers warranty covering parts and labour, unless specified otherwise.

If a product is installed and is found to be faulty you will need to call us on 0845 313 7650. We will then advise the appropriate course of action, which in many cases will be putting you in direct contact with the manufacturer. We may also require you to put the problem in writing to us, we will advise at the time should this be required.



Maintanence and Advice:

Following installation stone fireplaces will initially have components in varying degrees of drying out. This will give the stone components/sections different shades of stone/colour. A stone fireplace can take upto 8 weeks to fully dry out and revert to its natural dry colour.

All fireplaces using solid fuel should use small amounts of fuel for the initial 6 to 8 weeks following installation to enable the fireplace components to dry out naturally and adjust to their normal thermal expansion and contraction. We will not accept responsibility for fireplace components which crack or stain due to excessive heat on wood, iron, marble, granite, stone, slate, firebricks or firebacks after they have been supplied. This does not affect your statutory rights in relation to faulty goods.

Metalware used for fireplace components are supplied unlacquered due to their exposure to heat. Therefore, it is your responsibility to maintain brass, stainless steel or cast iron, which will discolour if not maintained at regular intervals after installation.
